Terms & Conditions

The following terms and conditions apply to all transactions on our online shop: www.kerolhardware.co.uk and off-line (Mail/Telephone/Fax Order) and Face-to-Face orders. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions. If you do not wish to accept this terms and Conditions, then you should leave the website and you should not register, place orders or browse the website.

Definitions

   "Business Customer" means those customers who purchase items for (or on behalf of) a business.

   "Consumer" means an individual who is not acting for the purposes of his or her business or profession.

   "Kerol" or "Kerolhardware.co.uk" means Kerol Hardware also referred to as "we", "us" or the ''seller'' in these terms and conditions.

   "Catalogue" means the catalogue of products and services offered by Kerol Hardware.

   "Force Majeure" means any cause affecting the performance by Kerol of its obligations arising from acts, events, omissions, happenings or non-happenings beyond its reasonable control including (but not limited to) governmental regulations, fire, flood or any disaster or industrial dispute affecting a third party.

   "Normal Working Hours" means 9:00 am to 4:30 pm on a Working Day / Business Day.

   "Working Day / Business Day" means Monday to Friday, excluding Bank Holiday or other Public holidays.

General – All quotations made and orders accepted are subject to our Conditions of Sale and no alterations to these conditions shall take effect unless confirmed by us in writing.

Ordering - To order goods from Kerol Hardware you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods and services subject to these terms and conditions. All orders are subject to acceptance and availability. We may refuse to accept an order

  • where goods are not available;
  • where we cannot obtain authorisation for your payment;
  • if there has been a pricing or product description error; or
  • if you do not meet any eligibility criteria set out in our terms and conditions.

Validity – Quotations and prices are subject to withdrawal or alteration in whole or in part at any time. Unless otherwise stated by us in writing, quotations are open for acceptance within 7 days of the date thereof.

Prices – Unless otherwise specified in quotations, our prices, subject to errors and omissions, include for supply only of the items specified. Prices charged will be those ruling at the date of dispatch. We reserve the right to change prices and / or specifications at any time without prior notice. All prices are exclusive of VAT, which will be charged as applicable.

Carriage – Carriage costs will be charged in full on all deliveries unless previously agreed. Minimum cost £6.50 (excl. VAT).

Delivery – Delivery dates are given in good faith but we accept no responsibility for failure to deliver on any given date. Delays in delivery, whatever the cause, do not give any right to reimbursement of damages of any kind.

Damage/Loss in Transit – Claims for non delivery must be notified to the seller in writing within 3 days of dispatch. Shortages and Damages must be notified to the us within 24 hours of delivery.

Retention of Title – All goods remain the property of KEROL HARDWARE until payment in full has been received and cleared.

Payment - Goods will be despatched only after we receive your cleared funds, unless a credit account has been agreed in advance.

Return Policy - You may return your order at any time within 14 days of receipt of the Product(s) and receive a refund of the price paid excluding shipping cost. You must communicate such cancellation and return the Product(s) to us in writing. After obtain your Return Authorisation (RMA) number, then you can return the Product(s) to us at your cost. All goods must be returned in the original or similar packaging/manner and in a resalable condition before we can issue a refund.

All refunds are credited to the original pay method. Send your package via an insured and prepaid method (we recommend Royal Mail Special Delivery). Include your RMA number (or order number / invoice number) and packing slip and please let us know the reason for the return. Shipping and handling fees are not refundable on returns.

Special Notes:

  • Shipping charges are not reimbursable unless the goods are faulty.
  • Return shipping charges for parcels that are refused / undelivered will be deducted from your refund.
  • All returns will be credited using the original form of payment.
  • We cannot accept used merchandise unless the goods are faulty.
  • Non-stock items, which have been specially ordered, may have to be sent back to the manufacturer for inspection and report. Carriage charges and any re-stocking charges will be deducted from the total refund value.
  • Fabricated goods cannot be returned unless proved to be faulty.
  • Please note this policy has some limitations and does not apply to business customers. (The Distance Selling Regulations do not apply to Business customers). We may accept return from Business Customers, however we reserve the right to charge 10-50% restocking fee.

Guarantee – We offer a 12 month guarantee (from purchase date) for all products which is subject to the following  terms: The extent of our liability in connection with component parts and equipment is limited to the extent of the guarantee given by the manufacturer of that part. Responsibility is limited to the repair or replacement of the unit or part thereof and in no case are we to be liable for the consequential loss or damage. Our responsibility under the clause shall cease if: a)The customer has not paid in full invoices for goods supplied by us within the time stipulated by these conditions; b)Our representatives are denied full and free right of access to the goods; c)The customer permits persons other than our employees or agents or these approved or authorised by us to effect any replacement of parts to the goods; d)The customer has not properly maintained the goods; e) The customer uses any spare parts or replacements not manufactured by or on behalf of us, and supplied by us.

Accuracy of Content
Kerol Hardware has taken every care to ensure that all photographs, drawings and descriptions on this site are a fair representation of the products for sale. Where possible, actual sizes are detailed with each item however some products may display larger or smaller than their actual size. Colours may vary slightly both due to minor errors from reproduction and variability of displays of computer monitors. Products drawing and dimension are for information purpose only and should not be used for glass cutting or project design before you receiving your goods and actually measure them yourself. All specifications are for reference only and are subject to change without prior notice. We reserves the right to revise, change or modify part numbers, specifications and prices of listed items without notice.

Third Party Liability – We shall not be responsible for damage, injury or loss of any kind whatsoever to any property or persons however arising from the use of goods or otherwise in connection with the installation. Nor shall we be responsible for any additional risks, which the customer's insurance company may consider to have been undertaken by reason of the delivery, installation or use of the goods supplied.

Disclaimer – If by reason of any circumstances whatsoever beyond our control, including (but without prejudice to the generality of the foregoing) War, Riots, Civil Commotion, Strikes, Lockouts, Fire, Explosions, Requisitions, and acts of God, we shall be unable to deliver any goods, we reserve the right to cancel the contract in respect of the goods being affected, and the contractual obligations in respect of these goods shall be wholly discharged.

In as much as we have no control over the final use to which goods supplied by us be put, we therefore do not warrant the goods will be fit for any particular purpose. So far as statute permits and other express or implied term, condition or warranty, whether arising under statute or otherwise, as to the fitness, suitability, quality conditions correspondence with description or sample or merchantability of the goods is hereby expressly excluded from the Contract terms.

Please Note: It is expressly understood that any technical advice furnished by us with reference to the use of goods is given without charge and we assume no obligation or liability for the advice given or results obtained, all such advice being given and accepted at your own risk.

  • Your exclusive remedy for breach of such warranty is limited to refund of purchase price or replacement of any product shown to be other than as warranted.

Legal Construction – The contract shall in all respects be constructed and operated as an English contract and in conformity with English law.

Data Protection - GDPR (The General Data Protection Regulation) is a really positive step towards you having more control over how your data is used and how you are contacted. We may transfer information about you to our bankers / financiers for the purposes of providing services and for the following purposes: obtaining credit insurance, making credit reference agency searches, credit control, assessment and analysis (including credit scoring, market, product and statistical analysis), securitisation and protecting our interest. We will provide you with details of our bankers / financiers and that of any credit reference agencies use on request.

These terms and conditions do not affect your statutory rights.
